Since 2006, Rogue Advocates has worked tirelessly to ensure that planning agencies follow land use laws that protect the public interest. Here are our accomplishments and the ways we've responded to emerging land use issues.
2022–2026
Monument Drive EFU Exception — Active Case
Rogue Advocates is actively analyzing the Rose Butte LLC application at 8980 Monument Drive in Josephine County, which seeks an "irrevocably committed" exception to Goal 3 (Agricultural Lands). Our research identified multiple legal vulnerabilities including an incorrect exception type, insufficient county findings during a 35-minute hearing, and internal contradictions on water availability.
Lower River Road Non-Farm Dwelling — Active Case
Monitoring a non-farm dwelling application on Lower River Road in Josephine County to ensure it meets the legal standards for dwellings on Exclusive Farm Use land.
Watchdog Land Use Monitoring System Launched
Deployed a new digital monitoring and publishing system that systematically tracks land use proposals across both Jackson and Josephine County planning departments, making case information accessible to the public in real time.
Grand Terrace Apartments — Final Approval
After multiple LUBA remands initiated by Rogue Advocates in 2021 and 2023, the Grand Terrace apartment complex won final Ashland City Council approval. The project incorporated fire-resistant construction, solar power, 24 affordable housing units, and all the safety and density improvements our multi-year advocacy secured.
Oregon Legislative Testimony — HB 2400, HB 2422 & HB 2316
Submitted formal testimony to the Oregon Legislature opposing three bills that threatened Oregon's land use framework. HB 2422 would gut safeguards allowing counties to sidestep impact analysis. HB 2316 would allow detached homes on state lands outside Urban Growth Boundaries, undermining sprawl prevention. HB 2400 set dangerous precedents undermining long-established land use laws that have made Oregon a national model.
Farm Stand Rules Engagement
Engaged with emerging Oregon DLCD regulatory changes around farm stand rules affecting rural farming operations, ensuring new regulations don't erode protections for agricultural land.
LUBA Victory: Josephine County Fire Protection Restored
Won a landmark appeal to LUBA after Josephine County Commissioners relaxed fire protection requirements for developments on farmland and rural residential zones. LUBA reversed the county's changes, restoring protections for approximately 35,000 rural residents in what ODF data identifies as "the number one county most vulnerable to wildfire in the state." Covered by OPB, Jefferson Public Radio, and KLCC.
Grand Terrace — Improved Project Returns
After two LUBA remands initiated by Rogue Advocates, the Grand Terrace apartment project returned to Ashland City Council with 20 fewer units, all one-bedrooms at 500+ sq ft, 24 affordable housing units, fire-resistant construction, and solar power. Rogue Advocates chose not to oppose the revised project, stating "many of their objectives had been achieved." Council approved it 6–0.
Sunny Valley Sand and Gravel Mine — Ongoing Monitoring
Published analysis on the proposed 112-acre, 20–40 year mining operation near Grave Creek in Josephine County — a coho salmon spawning tributary of the Rogue River. Continued tracking to ensure environmental and land use standards are met.
Urban Growth Boundary Advocacy
Published analysis on emerging threats to Oregon's Urban Growth Boundaries and worked to remove barriers to community participation in land use decisions across Jackson and Josephine Counties.
LUBA Victory: Grand Terrace Annexation Remanded Again
LUBA sustained Rogue Advocates' challenge to Ashland's approval of a 230-apartment annexation on Highway 99, finding the city's interpretation inconsistent with its own code regarding on-street parking exceptions and affordable housing minimum square footage. Proposed 499 sq ft one-bedrooms and 250 sq ft micro-studios fell below code minimums. This was the second LUBA remand for the project.
Wildfire Adapted Communities Stakeholder
Participated in DLCD's Wildfire Adapted Communities stakeholder group, providing recommendations to DLCD and the Oregon Legislature for incorporating wildfire considerations into land use planning statewide.
Stopped Aggregate Mining Near Shady Cove
Successfully opposed a proposed aggregate mining operation on nearly 64 acres north of Shady Cove in Jackson County. Mining would have occurred as close as 100 feet from residences and near Trail Creek, a Rogue River tributary. The county denied the application after sustained opposition from Rogue Advocates and community members.
Saved 90 Acres of Forest Land
Won an appeal to LUBA jointly with 1000 Friends of Oregon, preventing rezoning of ~90 acres (63 acres woodland, 24 acres meadows/wetlands) from forest to residential near Merlin, Josephine County. LUBA found the county "improperly relied on evidence that underrepresented the property's value as forest land." The decision prevented a precedent for converting forestland outside Urban Growth Boundaries and reduced wildfire risk.

Double Victory at LUBA
Won two legal challenges at LUBA in May 2021: the City of Ashland's Grandview Terrace annexation on Highway 99, and a Jackson County zone change near Jacksonville that would have set a precedent allowing unsustainable development on over 30,000 acres of rural lands.
Ashland Annexation Appeal
Appealed the City of Ashland's approval of a 17-acre annexation due to safety issues and car-centric development. Generated community discussion and media coverage. LUBA decided in Rogue Advocates' favor in May 2021.
Jackson Co. Aggregate Mine
Filed an appeal of Jackson County's approval of the Box R Aggregate Mine Conditional Use Permit to authorize an aggregate mine on a 42-acre parcel zoned as forest resource.
Phoenix & Talent Fire Response
The devastation of the Almeda fire reignited the Rogue Advocates board with fresh energy. Engaged in post-fire redevelopment efforts in Phoenix and Talent to ensure rebuilding followed sound land use practices.
Reducing Rural Sprawl
Appealed Jackson County's approval of a sweeping zone change that threatened to establish a legal precedent exacerbating sprawling rural residential development on over 30,000 acres. LUBA decided in Rogue Advocates' favor in May 2021.
Forestland Definitions
Forced Josephine County to apply new state laws used to define forestland. The county was reluctant, preferring its antiquated system that made it easier to convert forestland into rural sprawl.
Maintaining Quality Farmland
Closed the loophole in Jackson County allowing mining on farmland under the guise of a farm-use activity — a practice that needlessly destroys good farmland.
Preservation of Farmland
Partnered with 1000 Friends of Oregon to lead a campaign involving the public in the Greater Bear Creek Regional Problem Solving Process, which had proposed urbanizing thousands of acres of farmland. Reduced farmland loss and increased protections for farming in the region.
Envision the Rogue Valley
Conducted community education seminars engaging the public in envisioning alternatives to sprawl-based development. Funded by Meyer Memorial Trust, these forums culminated in a report and video.
